Jihad in Islam: A Historical and Jurisprudential Study — New RCD Translation

The book is a compilation of the scholarly lessons of Ayatollah Sheikh Ni'matullah Salehi Najaf-Abadi, reported by Allama Sheikh Muhammad Ali Kusha, and translated and investigated by Hassan Al-Sarraf.
The book offers a critical examination of one of the most complex topics in Islamic jurisprudence. It is structured into four primary chapters:
· Initial Jihad (Jihad al-Ibtida'i): The first chapter discusses the legitimacy and legal boundaries of "Initial Jihad" (offensive or preemptive war), a topic of intense debate among scholars.
· Rebellion and Reform: The second chapter addresses the jurisprudence of Bughat (rebels) and the problematic issue of rising against an unjust ruler, emphasizing the priority of dialogue and reform over armed conflict.
· Humanitarian Treatment: The third chapter focuses on the rulings regarding Prisoners of War, highlighting the humanitarian dimensions embedded in Islamic law.
· Economics of War: The fourth chapter delves into the distribution of war spoils (Ghanima), distinguishing between legal concepts such as Anfal, Fay', and Khums. It concludes with a critical reading of historical applications that may have contradicted the higher objectives (Maqasid) of Sharia.
